Attorney Gribouski Successful on Motion to Dismiss
February 10, 2017, Leominster District Court, Leominster, Massachusetts
Attorney James J. Gribouski’s client, a fifty-six year old Sutton, Massachusetts man was arrested by the Holden Police Department after allegedly swearing at a police officer. He was then charged with disorderly conduct and resisting arrest for supposedly tensing his wrists when the officer attempted to handcuff him.
Attorney Gribouski obtained the statement of facts upon which the court issued the complaint. Recognizing that the elements of both disorderly conduct and resisting arrest were not sufficiently set forth in the statement of facts, he filed a motion to dismiss. After hearing the judge dismissed both charges.
