Attorney Gribouski Successful in Suppressing Key Evidence in OUI/DWI Case in Uxbridge District Court

Attorney James J. Gribouski‘s client was arrested by an Uxbridge, Massachusetts Police Officer and charged with OUI/DWI. Attorney Gribouski’s client was stopped based upon the officer’s mistaken belief that the client had thrown a lit cigarette from his car’s window. In fact, it was the driver of the motor vehicle in front of the client’s vehicle who had thrown the cigarette.
Attorney Gribouski filed a motion to suppress the evidence gathered as a result of the stop based upon the argument that the officer lacked probable cause to make the stop. The judge agreed and allowed the motion to suppress which caused the Commonwealth to dismiss the case.
