Attorney James J. Gribouski Gets Breath Test Thrown Out; Judge Enters a Finding of Not Guilty

Attorney Gribouski’s client, a twenty-nine year old Holden, Massachusetts woman, was stopped for speeding by a Massachusetts State Trooper on Route 290 in Worcester, Massachusetts. The Trooper asked her to step from the vehicle to perform field sobriety tests. After doing so she was arrested for OUI/DWI. At the barracks she elected to take a breath test and registered over the legal limit.
Attorney Gribouski researched the breath test records and discovered an inaccuracy in the records. A motion to exclude the breath test from evidence was then filed. The judge allowed the motion and without the breath test the state was left with very little evidence. The judge then found her not guilty.
